Terms of Service

IMPORTANT NOTICE

CreditIQ IS NOT A LAW FIRM AND DOES NOT PROVIDE LEGAL ADVICE. THE SERVICE IS AN INFORMATIONAL TOOL THAT HELPS CONSUMERS IDENTIFY POTENTIAL INACCURACIES IN THEIR CREDIT REPORTS AND EXERCISE THEIR STATUTORY RIGHTS UNDER THE FAIR CREDIT REPORTING ACT. NOTHING IN THIS SERVICE CONSTITUTES LEGAL ADVICE, AND NO ATTORNEY-CLIENT RELATIONSHIP IS FORMED BY USING THE SERVICE.

1. Acceptance of Terms

By accessing or using the CreditIQ service (the “Service”) operated by Delvir Limited Liability Company (“CreditIQ”, “we”, “our”, or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

You must be at least 18 years old and a resident of the United States to use the Service. By using the Service, you represent and warrant that you meet these requirements.

2. Description of Service

CreditIQ provides a software tool that allows consumers to upload their own credit reports, identify potential discrepancies between reports from different credit bureaus, generate sample dispute letters, and track their dispute progress. The Service is designed to assist consumers in exercising their rights under the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.).

The Service does not guarantee any particular outcome, including but not limited to the correction of any credit report error, an improvement in your credit score, or the recovery of any monetary damages.

3. Not Legal Advice — No Attorney-Client Relationship

THE SERVICE IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY. CREDITIQ IS NOT A LAW FIRM. THE CONTENT PROVIDED THROUGH THE SERVICE, INCLUDING DISPUTE LETTERS, LEGAL SUMMARIES, AND GUIDANCE ABOUT THE FAIR CREDIT REPORTING ACT, DOES NOT CONSTITUTE LEGAL ADVICE AND SHOULD NOT BE RELIED UPON AS SUCH.

Your use of the Service does not create an attorney-client relationship between you andCreditIQ or any of its employees, contractors, or affiliates. If you need legal advice specific to your situation, consult a licensed attorney in your jurisdiction.

Attorney referrals facilitated through the Service are provided solely as a convenience. CreditIQ makes no representations about the qualifications, competence, or suitability of any referred attorney. Any engagement with a referred attorney is solely between you and that attorney.

4. Your Responsibilities

By using the Service, you represent and warrant that:

  • You are uploading only your own credit reports, obtained from authorized sources (e.g., annualcreditreport.com).
  • All information you provide is accurate and truthful to the best of your knowledge.
  • You will use the Service only for lawful purposes and in accordance with these Terms.
  • You will not use the Service to upload any other person's credit report without their explicit written authorization and legal authority to do so.
  • You will not reverse engineer, scrape, or attempt to access the Service's underlying systems, APIs, or data.
  • You will not use the Service in any manner that could disable, overburden, or impair the Service.
  • Any dispute letters generated by the Service that you choose to send are your sole responsibility. You are responsible for reviewing all dispute letters for accuracy before sending them.

5. Payment Terms

Certain features of the Service require a one-time payment of $14.95 (the “Report Fee”). Payment is processed by Stripe, Inc. By completing a payment, you authorize us to charge the applicable fee to your payment method.

Refunds. The Report Fee is non-refundable once your full discrepancy report has been delivered, except as required by applicable law. If you experience a technical failure that prevents delivery of your report, contact team@delvir.co within 7 days for a full refund.

All prices are in U.S. dollars. We reserve the right to change pricing at any time, with changes taking effect for new purchases only.

6. Credit Report Data — Your Consent

By uploading your credit reports, you expressly consent to CreditIQ processing the contents of those reports solely to provide the Service to you. You acknowledge that:

  • Your credit report PDFs will be transmitted securely, processed to extract discrepancy data, and retained securely with your account so you can revisit your analysis.
  • Discrepancy data extracted from your reports (account names, discrepancy types, potential damages estimates) is retained in your account for your reference.
  • You obtained your credit reports through legitimate means and have the legal right to share them with service providers for the purpose of credit repair and dispute assistance.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

CREDITIQ DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (B) ANY DISCREPANCIES IDENTIFIED BY THE SERVICE ARE IN FACT ERRORS OR ACTIONABLE UNDER THE FCRA; (C) DISPUTING ANY IDENTIFIED DISCREPANCY WILL RESULT IN A CORRECTION, IMPROVEMENT IN CREDIT SCORE, OR MONETARY RECOVERY; OR (D) THE DISPUTE LETTERS GENERATED ARE LEGALLY SUFFICIENT FOR ANY PARTICULAR PURPOSE.

Credit report analysis is based on a comparison of the data contained in your uploaded reports. Discrepancies identified by the Service may or may not constitute violations of the FCRA. The actual merit of any claim is a legal determination that only a licensed attorney can make.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CREDITIQ AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL CREDITIQ'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO CREDITIQ IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $14.95.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

9. Indemnification

You agree to defend, indemnify, and hold harmless Delvir Limited Liability Company, its members, managers, employees, and contractors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) any dispute letter you send to a credit bureau; (d) any claim by a third party arising from your use of the Service; or (e) your violation of any applicable law or the rights of any third party.

10. Third-Party Services

The Service integrates with or references third-party services, including Stripe (payments), Google (authentication), and the Consumer Financial Protection Bureau (cfpb.gov). These services are governed by their own terms and privacy policies. CreditIQ is not responsible for the content, practices, or availability of any third-party service.

Attorney referrals are provided as a convenience only. CreditIQ does not endorse, recommend, or guarantee any referred attorney. Any legal representation agreement is solely between you and your chosen attorney, and CreditIQ is not a party to any such agreement.

11. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Delvir Limited Liability Company. The Service is protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our express written permission.

Dispute letters generated by the Service based on your credit report data are provided to you for your personal use. You own the right to use and send those letters.

12. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to violation of these Terms, fraudulent or abusive use of the Service, or any activity that harms CreditIQ or other users.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including Sections 3, 7, 8, 9, 13, and 14) shall survive.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Any dispute arising out of or related to these Terms or the Service that cannot be resolved informally shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction for claims involving intellectual property or unauthorized use of the Service.

Class Action Waiver. You agree that any arbitration or proceeding shall be limited to the dispute between you and CreditIQ individually. To the fullest extent permitted by law, you waive the right to participate in a class action lawsuit or class-wide arbitration.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the effective date and provide at least 14 days' notice by email or prominent notice on the Service before the changes take effect. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Delvir Limited Liability Company regarding the Service and supersede all prior agreements, understandings, and representations. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
